TutorSplash Terms & Conditions

1. Platform Overview

TutorSplash is an online educational platform based in Ontario, Canada, that enables qualified tutors ("Tutors") to offer and conduct live one-on-one and group classes for students ("Learners"). Parents or legal guardians ("Parents") may register Learners under the age of majority. TutorSplash acts solely as a facilitator between Tutors and Learners and is not a party to any agreement between the two. Parents and Tutors acknowledge that TutorSplash is not a broker, agent, or insurer for any party.

2. Account Creation & Eligibility

a. Tutors: All tutors must provide accurate and verifiable personal and professional information during the account creation process, including academic qualifications, teaching experience, and government-issued identification. TutorSplash reserves the right to verify this information and approve or reject accounts. Periodic reviews may be conducted to maintain quality standards. Tutors must also agree to ongoing compliance with TutorSplash’s Code of Conduct and Community Standards.

b. Students & Parents:
Students must provide accurate registration information. Minors require parental or guardian consent, and the responsible adult assumes liability for session conduct and financial Users under the age of 18 must be registered by a Parent or legal guardian. Parents accept full responsibility for the Learner's conduct and agree to these Terms on their behalf.

  • Parental Consent for Minors
    Parents must consent to minor accounts and are responsible for session activity. TutorSplash disclaims liability for tutor-learner interactions but may intervene in disputes.

c. Account Security: Users are responsible for maintaining the confidentiality of their account credentials and any activity under their account. Unauthorized use must be reported immediately.

3. Tutor Responsibilities

Tutors are expected to conduct themselves professionally and ethically in all interactions with students. They must deliver tutoring services as advertised, including subject expertise, punctuality, and preparedness. Tutors are required to adhere to scheduled session times and notify students promptly of any changes or cancellations. Tutors shall ensure a safe, inclusive, and respectful learning environment for students of all backgrounds.

  • Conduct sessions professionally and ethically.
  • Be punctual, prepared, and adhere to advertised session formats.
  • Maintain communication through TutorSplash only.
  • Consent to session recording for quality assurance and dispute resolution.
  • Refrain from soliciting learners outside the platform or engaging in prohibited content.

3.a Prohibited Conduct for Tutors

  • Soliciting students to book or pay for sessions outside the platform.
  • Sharing personal contact details to bypass platform policies.
  • Engaging in harassment, discrimination, or unprofessional conduct.
  • Misrepresenting qualifications or experience.
  • Violating Canadian privacy laws or TutorSplash policies. Violations may result in account termination or legal action.

3.b Content Ownership for Tutors

  • Tutors retain ownership of their instructional materials but grant TutorSplash a non-exclusive, royalty-free license to use, reproduce, store, and display such content to facilitate services. Tutors must not upload copyrighted materials unless authorized.
  • TutorSplash reserves the right to use tutors’ names, profiles, and images shared on the platform for marketing and promotional purposes.

4. Student Responsibilities

  • Arrive on time and prepared.
  • Adhere to the code of conduct: respectful communication, appropriate behavior, and adherence to tutor instructions.
  • Refrain from bypassing the platform’s payment system.

4.a Prohibited Actions for Students

  • Circumvent payment systems.
  • Provide false or misleading information.
  • Engage in conduct unrelated to tutoring (e.g., spamming or fraud).

4.b Code of Conduct for Students

  • Students must adhere to the community standards by behaving respectfully, avoiding harassment, and following tutor guidelines. Inappropriate behavior may lead to suspension or termination.

5. Session Types & Durations

  • Lesson Durations: One-on-one lessons: 30 or 60 minutes.
  • Trial Lessons: 15 minutes only.
  • Group Classes: 30 or 60 minutes.
  • Maximum learners per class: 20.

6. Booking, Rescheduling, and Cancellations

a. Booking:

Students must prepay for sessions using the virtual wallet system. A payment service fee applies when funding the wallet. Transactions outside the platform are not permitted. Refunds are governed by TutorSplash’s cancellation and refund policy

  • Bookings must be prepaid via the platform.
  • Funds are stored in the student's virtual wallet for tutor payments.

b. Rescheduling & Cancellation Windows:

  • Lessons: Reschedulable or cancellable up to 4 hours prior.
  • Group Classes: Cancellable up to 8 hours prior.

*Cancellation and Refunds

  • Cancellations within allowed times qualify for full refund.
  • Tutor-cancelled sessions will be refunded or rescheduled.
  • Refunds are processed through the wallet system.
  • Tutors may be asked to reimburse refunds if already paid.

c. Refund Eligibility:

  • 100% refund for cancellations:
    o At least 24 hours before a lesson.
    o At least 8 hours before a group class.
  • 0% refund for cancellations after those windows.
  • Unscheduled sessions canceled will be refunded 100%.

d. No-Shows & Auto-Completion:

  • Tutors may end a session if Learner is absent for 20 minutes.
  • Sessions auto-complete 2 hours after the scheduled time.

e. Refund Abuse:

  • TutorSplash reserves the right to deny refunds for excessive or unreasonable refund requests.

7. Earnings and Payments for Tutors

Tutor payments are processed through Stripe. Tutors earn 70% of the class or session fee; TutorSplash retains a 30% commission as a platform fee. Payments are issued upon tutor request and are not processed automatically. Tutors must enter valid Stripe payout details in their account settings and are responsible for updating their information as needed. All payouts are subject to verification and compliance with TutorSplash’s fraud prevention policies.

If a tutor has already been paid and a refund is required due to missed or canceled sessions, TutorSplash may request the tutor to return their share within seven (7) days. Tutors who fail to comply may have their listings paused or account deactivated.

  • TutorSplash deducts a 30% commission on session earnings.
  • Payments are processed via Stripe and made upon tutor request.
  • Tutors must link valid payout information and are responsible for keeping it updated.
  • Tutors are not permitted to collect payments or solicit sessions outside the platform.

Refund Responsibility: If a tutor cancels or misses a session:

  • A full refund is issued to the student.
  • Tutors may be required to reimburse TutorSplash for any payout received within 7 days.

8. Platform Fees

TutorSplash charges:

  • 30% commission on tutor earnings.
  • Payment service fee on wallet funding.
  • Additional service charges as disclosed. Bypassing fee structures is grounds for account suspension.

9. Content and Recordings

  • Tutors retain intellectual property rights to uploaded content.
  • By uploading, Tutors grant TutorSplash a non-exclusive, royalty-free license to use content for platform operations.
  • All sessions may be recorded for quality assurance and support purposes.
  • Recordings are accessible to support staff and may be shared with parents upon request.
  • Recordings are stored securely for up to 90 days and may be deleted earlier at TutorSplash’s discretion.
  • Users may request deletion of session recordings subject to privacy obligations.

10. Class Conduct & Community Standards

  • No discrimination, harassment, or misconduct.
  • Tutors must offer inclusive, secular, and fact-based instruction.
  • Lessons must not include medical, therapeutic, or pseudo-scientific claims.
  • Sensationalized content is prohibited.
  • Students and tutors must adhere to respectful communication, proper dress, and community values.

11. Session Refunds and Disputes

  • Refunds are handled on a case-by-case basis in accordance with cancellation policies.
  • Prorated refunds may be issued if a class is canceled mid-series or shortened.
  • Refunds are processed through the wallet system.
  • TutorSplash reserves the right to resolve disputes at its sole discretion.

Dispute Resolution

Disputes are mediated by TutorSplash. All decisions are final. TutorSplash may offer refunds or credits at its sole discretion. TutorSplash does not offer arbitration but encourages amicable resolution through its support channels.

12. Promotions and Referral Program

  • Promotional offers may be subject to limitations and expiration.
  • Referral bonuses:
    • Referrer and referee both receive 5 points upon the referee’s first purchase.
    • Points are non-cash and expire after 60 days.
  • Promotional codes and discounts may not be redeemed for cash and are subject to change.

13. Privacy & Data Protection

TutorSplash complies with PIPEDA and Canadian data privacy laws. All session recordings are stored securely and used only for quality assurance, security, or dispute resolution. Personal data is never sold. Users may access, update, or delete their data upon request.

  • All data is handled in accordance with PIPEDA and other Canadian privacy laws.
  • Users consent to recording and monitoring for platform safety and quality.
  • Data may be disclosed if required by law.
  • Users may request access to or deletion of their personal data.

14. Third-Party Services and Links

  • The platform may link to or integrate with third-party tools such as Google Meet or PayPal.
  • These tools are not controlled by TutorSplash.
  • Users assume all responsibility for using third-party platforms.

15. Termination of Accounts

  • TutorSplash may suspend or delete accounts due to inactivity, repeated poor reviews, policy violations, or misconduct.
  • Tutors and students will be notified and may appeal.

16. Copyright & Intellectual Property

  • Users may not upload or use copyrighted content without authorization.
  • IP claims will be addressed per Canadian law.
  • Copyright takedown requests may be sent to: support@tutorsplash.com

17. Limitation of Liability

  • TutorSplash is not liable for the outcomes of tutoring sessions.
  • Total liability is limited to the amount paid to the platform within the last 6 months or $100, whichever is greater.

18. Dispute Resolution & Arbitration

  • Users agree to first attempt to resolve disputes amicably by contacting TutorSplash Support.
  • If resolution is not achieved, disputes may be subject to binding arbitration in Ontario.
  • Users waive the right to participate in class actions.
  • Arbitration will be confidential and final, with fees shared by both parties.

19. Governing Law

These Terms shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute not resolved through arbitration will be subject to the exclusive jurisdiction of the courts located in Ontario.

20. Amendments

TutorSplash reserves the right to update these Terms at any time. Continued use of the platform constitutes acceptance of any changes. Users will be notified of significant updates via email or in-app notification.
